The Mothers for Peace has been in litigation regarding the dry cask storage facility at the plant. When denied a hearing by the Nuclear Regulatory Commission (NRC) on environmental impacts of intentional attack on the facility, Mothers for Peace appealed to the Ninth Circuit Court. The favorable ruling in this court in 2006 (later upheld by the Supreme Court) is important because it was the first time that the NRC had been required to address the environmental impacts of deliberate attacks. The Court’s decision has potential legal and security consequences for every nuclear facility in the U.S., as it has already been cited in support of other cases. Mothers for Peace continues its legal challenges to force the NRC to fully comply with the Ninth Circuit Court ruling.
