NRC orders revised environmental assessment as a result of MFP winning lawsuit

Today the Nuclear Regulatory Commission (NRC) ordered staff to prepare a revised environmental assessment of the Diablo Canyon dry cask storage project. The order is a direct result of the June 2, 2006 ruling of the Ninth Circuit Court of Appeals, in which that Court agreed with San Luis Obispo Mothers for Peace (MFP) that in accordance with the National Environmental Policy Act (NEPA), the NRC must take into account the environmental effects of a terrorist attack on that additional radioactive waste storage facility, currently under construction.

"Mothers for Peace is concerned about the short 90-day target time for this study. We will be watching to be sure the resulting study is done thoroughly and in accordance with federal law and the Ninth Circuit Court ruling," said MFP Spokesperson Jane Swanson.
