NRC reaffirms its Finding of No Significant Impact from a terrorist attack on the dry cask fuel storage at Diablo Canyon nuclear plant
The Nuclear Regulatory Commission (NRC) on August 30 reaffirmed its Finding of No Significant Impact from a terrorist attack on the dry cask fuel storage at Diablo Canyon nuclear plant.
San Luis Obispo Mothers for Peace (MFP) won a ruling in Federal Court in June of 2006 forcing the NRC to address the environmental effects of a terrorist attack, as required by the National Environmental Policy Act.
MFP asserts that the NRC conclusion contradicts significant factual evidence that the impacts of attacks would indeed be severe. The NRC's Environmental Assessment (EA) is so poorly written that it is impossible to determine how or whether the NRC considered the evidence and reached its contrary conclusion.
According to MFP spokesperson Jane Swanson, "This decision by the NRC makes a mockery of federal environmental law and the requirement for public disclosure and participation in the NRC's environmental decision-making process. Given the potentially devastating impacts of an intentional attack on the Diablo Canyon dry cask storage facility, the gross deficiencies in the NRC's EA are inexcusable. "
MFP has instructed attorney Diane Curran to press ahead with a request to the NRC for a hearing.
